Serparation and divorce
Around 150,000 marriages end in divorce every year, leaving many thousands of ex spouses and partners shocked at how much money they have either spent on the divorce/separation or how badly off they have come out of it financially.
Many separating couples assume that assets will simply be divided 50 / 50, but negotiations often come down to who needs the most to maintain their lifestyle, who put most in, who owned what before the relationship started, and the needs of any children.
What about your pension? The courts can now order pensions owned by either party to be shared, so that they can achieve a ‘clean break’ and overall a fairer financial settlement.
Co-habiting - who owns the home? If it is in the name of your partner, then it belongs to them. You can only claim a share if you have put money into the structure and fabric of the building. Just paying the bills does not automatically entitle you to any money from the property, even if you’ve stopped working to raise children from the relationship. Even owning the home in joint names doesn’t guarantee a 50 / 50 split. Many factors can affect the final outcome; children in particular. The Government does have plans to try to make the situation fairer for co-habiting couples who separate, but these changes are some way off yet.
